You are responsible for maintaining the security of your account and password. PetPond cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You may not use the Service for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any PetPond’s customer, employee, member, or officer will result in immediate account termination.

You expressly understand and agree that PetPond shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from: (a) the use or the inability to use the service; (b) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (c) unauthorised access to or alteration of your transmissions or data; (d) statements or conduct of any third party on the service; (e) or any other matter relating to the service.

PetPond reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us.

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

A valid credit card is required for paying accounts.

Billing is issued on a 30-day cycle.

The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for days unused with an open account. No exceptions will be made.

There is no contract for your subscription and you may cancel at any time. You may cancel your subscription by selecting the cancellation button from your account and by following the instructions properly. Emailing or phoning PetPond will not automatically cancel your subscription.

Cancelling your subscription may immediately delete data stored for your account and cannot be recovered once your account is cancelled.

If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again. No credit for partial month usage will be issued.

Termination: In its sole discretion, PetPond has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other PetPond service, for any reason at any time.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

General: Title to, and all Intellectual Property Rights in the Services, the Website and any documentation relating to the Services remain the property of PetPond (or its licensors).

Ownership of Data: Title to, and all Intellectual Property Rights in, the Data remain Your property. However, Your access to the Data is contingent on full payment of the Access Fee when due. You grant PetPond a license to use, copy, transmit, store, and back-up Your information and Data for the purposes of enabling You to access and use the Services and for any other purpose related to provision of services to You. You also grant PetPond a license to use your data for statistical and marketing purposes.
